Zwingende Voraussetzung der Zulassung eines neuen Arzneimittels ist dessen vorherige klinische Prfung. Diese ist jedoch trotz der hohen Sorgfaltsanforderungen - mit gesundheitlichen Risiken fr die Studienteilnehmer verbunden. Zur Kompensation prfungsbedingter Gesundheitsschden sieht die (deutsche) Rechtsordnung eine Kombination von Ersatzansprchen gegen die Beteiligten der klinischen Arzneimittelprfung und die gem. 40 Abs. 1 S. 3 Nr. 8, Abs. 3 AMG abzuschlieende Probandenversicherung vor. Dieses kombinatorische System als Teilaspekt des Probandenschutzeswird im Rahmen der vorliegenden Arbeit einer umfassenden Untersuchung unterzogen. Dabei werden Voraussetzungen, Umfang und Durchsetzbarkeit mglicher Entschdigungsansprche des Probanden analysiert. Die Verfasserin gelangt zu dem Ergebnis, dass das derzeitige Schadensausgleichsmodell in weiten Teilen unangemessen ist und stellt Reformberlegungen an.
