Das europische Recht ist ein entscheidender Faktor der Integration Europas besonders auch in Zeiten der politischen und konomischen Krise. Zugleich lsst sich die europische Rechtsgemeinschaft nicht als bloes Beiprodukt politischer Entscheidungen und Prozesse verstehen, sondern muss als ein spezifischer und eigenstndiger Kontext der Integration begriffen werden. Wer also die Integration durch Recht und die Rolle des Europischen Gerichtshofs (EuGH) im Einigungsprozess erfassen will, so die zentrale These dieses Buches, muss sich mit dem europischen Rechtskontext und der ihm immanenten Rationalitt auseinandersetzen. Ausgehend von den Arbeiten Max Webers und Ludwig Wittgensteins wird hier mit dem Konzept der Kontextrationalitt ein neuer und vielversprechender analytischer Weg fr die theoriegeleitete Integrationsforschung entwickelt. Anhand von aktuellen Fallstudien zur Grundrechtsjudikatur des EuGH wird zudem gezeigt, wie eine Kontextanalyse zu einem angemessenen Verstndnis von Integrationsprozessen durch Recht nicht nur in Europa fhren knnte.
