Der moderne Rechts- und Gesetzgebungsstaat ist Ausdruck rationaler Gestaltung der Welt aus dem Geiste aufgeklrter Vernunft. Zu deren Selbstverstndnis gehrt es, Mythos durch Logos und Rituale durch rationale Verfahren zu ersetzen. So versteht sich der Verfassungsstaat als auf Rationalitt gegrndet und sich in rationalen Diskursen der Rechtsprechung und Wissenschaft entfaltend. Doch der Glaube an die Entmythologisierung von Staat und Verfassung ist selbst ein Mythos. Denn der Mythos gibt, was Rationalitt nicht vermag: den Willen des Menschen zum Sinn durch Erzhlungen zu befriedigen. Mythen sind zwar nur Mglichkeiten des Denkens, schaffen aber die Wirklichkeiten des Seins. Eine Lehre der politischen Ordnung kann und darf daher ihre wirkmchtige Realitt nicht ignorieren. Den mythischen Dimensionen und Implikationen von Staat, Nation und Verfassung nachzuspren, ist Anliegen dieses Sammelbandes.
