Diese definiert sich als die Konkretisierung des normativen Gehalts der Verfassung unter Einbeziehung der faktischen Wirklichkeit eines konkreten Problems. Als hermeneutischer Prozess der Verfassungskonkretisierung ist die Argumentationsweise des Gerichts nur aus einer Korrelation zwischen gerichtlicher Demokratietheorie und gelebter Demokratiepraxis heraus zu verstehen.
